An application has been received by Wollondilly Shire Council under Section 96(2) of the Environmental Planning and Assessment Amendment Act, 1979 to modify Development Consent No. I438/99 which consented to development described as Intensive Horticulture – Orchard. The Section 96(2) Modification seeks approval to amend the growing areas.
The Application is a form of Nominated Integrated Development under Clause 5(1)(b) of the Environmental Planning and Assessment Regulations 2000. Approval for the proposed development is required from the Department of Primary Industries - Water under the Environmental Planning and Assessment Act, 1979, in respect of a licence under Section 91 of the Water Management Act, 2000.
The notice advertised in the paper on 8 March 2017 and 10 March 2017 is superseded by this notice.
The application and plans relating to the proposal may be inspected at Council’s Offices, 62-64 Menangle Street, Picton, between 8.00am and 4.00pm, Monday to Friday (public holidays excepted) for 30 days commencing 23 March 2017. Any person may make a written submission concerning the proposed modification. Submissions will be received until 4.00pm on 24 April 2017.
Should Council consent to the Section 96 application, there is no right of appeal under Section 98 of the Act by an objector.
