Cross Street Planning Proposal and Biocertification Strategy

Council invites the community to provide feedback on a Planning Proposal and accompanying Biocertification Strategy at Cross Street Tahmoor to rezone rural land for the purposes of housing and to enable environmental conservation. Your response is important and will assist us in making the right planning decisions for your local area.


Planning Proposal

The planning proposal is to amend Wollondilly Local Environmental Plan (WLEP) 2011, which is principal legislation that controls development and planning decisions for the Wollondilly Shire local government area. The proposal has been prepared in accordance with section 55 of the Environmental Planning and Assessment Act 1979 (EP&A Act) and relevant Department of Planning guidelines including A Guide to Preparing Local Environmental Plans and A Guide to Preparing Planning Proposals.


Application for Conferral of Biodiversity Certification

An application has been made under section 126M of the Threatened Species Conservation Act 1995 to confer biodiversity certification on land in the Cross Street Planning Proposal site.
Biodiversity certification provides a process to assess biodiversity early in the planning process (at the strategic planning stage) for areas being considered for development. The process identifies areas of high conservation value which are to be avoided and protected while identifying areas suitable for development.
The process identifies areas that can be developed after they are certified and measures to offset the impacts of development. Biocertification can speed up the planning process by considering biodiversity at the strategic planning stage at a landscape scale. Where land is certified, development may proceed without the usual requirement for site by site assessment through a threatened species assessment at the development application stage.

Note:  The Ecological and Riparian Assessment 2013 (Appendix 6b) includes biodiversity related material which is out of date and has been superseded by the Biodiversity Certification Assessment Report and Strategy 2018 (Appendix 6a).  However the riparian assessment remains valid.


Location of Planning Proposal

The planning proposal site comprises 8 properties located between River Road, Cross Street, Progress Street and the Bargo River at Tahmoor. These properties are Lot C DP 374621, Lots 1, 2, 3, 4, 5 & 6 DP 1128745 and Lot 255 DP 10669.

Details of Planning Proposal

The planning proposal aims to develop around 240 residential lots of 700, 975, 1500 and 4000 square metres and a small number of larger lots will also be zoned for environmental management purposes. A major portion (72 hectares) of land is proposed to be zoned for environmental conservation. Environmental buffers around the Bargo River and Bargo Gorge aim to protect its biodiversity, scenic and recreational importance.

Comments should be received by no later than Monday 14 May 2018 so that feedback can be used in preparing a report for the Ordinary Meeting of Council.


Report to Ordinary Meeting of Council

A report is expected to be considered at an Ordinary Meeting of Council after notification to determine whether Council will proceed to commence the process of rezoning this land. Those who make a submission shall be further notified of the dates and times when Council will consider this report.
