Draft Planning Agreement - Land at 1-41 Marsh Road Silverdale

Wollondilly Shire Council and Simba Developments Pty Ltd have negotiated a Draft Planning Agreement for land at 1-41 Marsh Rd Silverdale, formerly part of the site occupied by the old African Lion Safari Park.

The Draft Planning Agreement has been prepared under Section 7.4 of the Environmental Planning and Assessment Act 1979, and was prepared in association with a development application (DA) for the site for 425 residential lots (plus a residual lot). Council agreed to exhibit the Draft Planning Agreement at its meeting in April 2018. The consent authority for the DA is the Sydney Western City Planning Panel (Planning Panel), which considered the proposal site on 18 June 2018. One of their conclusions was that the Draft Planning Agreement be exhibited and reported on before the DA is determined. The Draft Planning Agreement is now being exhibited in accordance with the Council resolution and the recommendation of the Planning Panel.

The Draft Planning Agreement provides for the following:
• Dedication to Council of approximately 2.56 hectares of land for use as open space;
• Dedication to Council of drainage infrastructure and the land on which it is built;
• The carrying out of works including open space embellishment and cycleways on the site;
• Provision of money to be used to maintain drainage works and bushland areas on the site;
• Dedication to Council of land being protected under a Biobanking Agreement;
• Provision of a Monetary Contribution of approximately $4.9 million and its allocation towards purposes such as roadworks including upgrades to Marsh Rd, a regional playground, bus shelters and the like;
• Deregistration of an executed Planning Agreement off the title off the site;


Viewing of Documents

The Draft Planning Agreement, Explanatory Note, Development Application and associated documentation will be on public exhibition from Monday 23rd July 2018 until Monday 20th August 2018. The exhibition material will be available at the following locations:

• Council's Administration Building, 62-64 Menangle Street Picton (between 8.30am - 5.00pm Monday to Friday);
• Wollondilly Library located at 42 Menangle St Picton (between 9.30am- 5pm Monday to Friday and 9.00am - 12 noon on Saturday).


Making a submission

Submissions on the Draft Planning Agreement are now invited. Submissions must be in writing and must be received no later than 5pm on 20th August 2018 and should quote reference number TRIM 1765. They can be submitted by:

Any submission you make is open to public scrutiny. Council is required to release written comments or submissions under the Government Information (Public Access) Act 2009 {GIPAA]. The Act imposes obligations on us to place submissions on Council's website and submissions may be used in Council reports or court proceedings. In this regard, your comments should be restricted to the proposed development.
